Detective services Act dated 6 of July 2001 (Dz.U. 2002 no 12 item 110) (change: Dz.U. 2002 no 238 item 2021; 2003 no 124 item 1252; 2004 no 121 item1265 no 173 item 1808.

SELECTED ARTICLES


Article 2.( Terms of detective services)
1. Detective services are the sevices consisting in obtaining, processing and transmission of information about persons, things and events, performed on the grounds of agrement concluded with Client in form and scope mot reserved for state organs and institutions on the strength of separate regalations and particularly:

1) in cases resulting from legal relations concerning individual persons

2) in cases resulting form economic relations concerning:


a) executing property obligations, payment abilities or credibility in the relations,

b) unlawfully taking advantage of trade names or trade marks, unfair competition or disclosing of information being an trade secret.

3) checking of credibility of information concerning damages reported to insurance companies,

4) searching for lost or hidden persons,

5) searching for property,

6) gathering information in the case, in which penal proceeding, proceding in treasury offence or treasury crime or others are in course and penal regulation can be applied,

2. Operation mentioned in number 1 point 6 cannot be taken by organs carrying on or supevising procedure in these cases.

 

Article 3.(Registration)
1. Performimg activities in the scope of detective services is the activity regulated by rules of Act dated 2 Jyly 2004 on liberty of business activity (Dz.U. no 173 item 1807) and it requires to obtain registration of detective activity called thereafter "registration".

 

Article 4.(Licence)
1. Carrying on activities mentioned in article. 2 point 1 in the framework of economic activity requires obtaining a licence of a decective called thereafter "licence".

2. According to the Act only person having licence can be a detective.

3. Professional title detective can be used only by a person having licence.

 

Article 6. (Rules of doing the activities) Doing activities mentioned in Article 2 point 1 detective should observe ethical rules, loyalty toward employer of the servise and particular accuracy in ordet not to disturb freedom and human and civil rights. Article 9. (Gathering information) In case regulations of other Acts do not determine otherwise, detective, in course of activities mentioned in Article 2 point 1, can gather information from individual persons, businessmen, intitutions as well as governemental administrative or self-governed organs

 

Article 12. (Keeping secret)
1. Detectiv is obliged to keep secret sources of information and circumstances of the case, which obtained in course of performing activities mentioned in Article 2 point 1.
